In California there are two ways to qualify for Chapter 7 Bankruptcy. Both of them are dependent upon your income. The first way is called the median income test and what we do is we average your gross monthly income for the last six months and then we compare that income with the median income with the State of California and if it is less than the median income then you qualify for chapter 7, if it is more you do not.
The second test is called the means test. That is where people who do not qualify for the median income test, the bankruptcy court will look at a more in depth study of their income and expenses.
